The Magee Clothing Limited B2B website is provided solely for your business use.

Magee Clothing Limited B2B only offers products for sale that are in stock and available for dispatch from its warehouse. Although much effort has gone into producing high quality images of our product selection, we cannot guarantee that your monitor will correctly replicate the colours.

Magee Clothing Limited B2B reserves the right to modify these Terms of Conditions from time to time.

2. TERMS OF SALE AND CARRIAGE

2.1. By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

2.2. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

2.3. In order to contract with Magee Clothing Limited B2B you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Magee Clothing Limited B2B retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.

2.4 Important statutory conditions of carriage. Notice of non-delivery must be given to us no later than 14 days from date of invoice. Notice of re-damage must be given to us and the carrier within 3 days of receipt of goods. Failure to comply with the above may result in the claim being “time barred” by the carrier.

3. OUR CONTRACT

3.1. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

4. PRICING AND AVAILABILITY

4.1. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

4.2. The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

5. PAYMENT

5.1. Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

5.2 All goods delivered remain property of Magee Clothing Limited until the goods and all other goods agreed are sold for which payment is due are paid in full.

5.3 The Risk in the Goods shall pass to the Customer on delivery

5.4 The Customer shall pay the invoice in full and in cleared funds in accordance with the terms shown on the Company’s invoice and within 30 days of the date of invoice, unless otherwise agreed in writing between the Company and Customer.

5.5 In the event any discount has been applied which is conditional, and the conditions are no longer satisfied, the Company shall be entitled to withdraw the discount and invoice the total cost of therelevant Goods to the Customer.

5.6 If the Customer fails to make any payment due to the Company by the due date for payment, the Company shall be entitled to charge interest on the amount overdue at the rate of 5% per annum

5.7 The Company reserves the right to suspend further deliveries when payment terms have not been observe

6. DISCOUNT CODES

6.1. Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue.

7. INTELLECTUAL PROPERTY

7.1. Nothing contained on the Web Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on this Web Site without the written permission of Magee Clothing Limited or such third party who owns the trademark. Your misuse of any trademark displayed on the Web Site, or any other content on the Web Site, except as provided herein, is strictly prohibited.

9. PUBLIC FORUMS AND USER SUBMISSIONS

Magee Clothing Limited B2B is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms, blogs, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by Magee Clothing Limited B2B. Magee Clothing Limited B2B reserves the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion that you are or there is the likelihood that you may, including but not limited to -

10. SPECIFIC USE

10.1. You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby indemnify the Website Owner against any loss, liability, damage or expense of whatever nature which the Website Owner or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

11. REGISTRATION

11.1. By subscribing to our database, you agree that your details including your email address will be used to keep you informed about Magee Clothing Limited B2B news, promotions and products . The personal information you give us is kept secure and processed fairly and lawfully. We will not share your information with third parties for marketing purposes.

12. HOW TO PLACE AN ORDER

12.1. In order to make purchases through the Site, you will need to create an online account the first time you use the Magee 1866 Online Shop and you will be requested to provide information about yourself as indicated so that we may process your Order. You represent and warrant that the information provided by you is both valid and correct.

12.2. Once you have chosen a product, click on the image to access the product page where information on sizing, colour options and availability will be provided. All the prices are in Euro, with the option to see the price in Sterling or Dollars on that day’s current exchange rate. The prices will include VAT, but will not include delivery rates, as they vary from country to country. The cost of delivery will be clearly indicated further on in your order process.

12.3. If you are happy with your choice, click on the "Add to Basket" button.

12.4. You can monitor the products you have chosen by clicking on the "Shopping Basket" button at any time. You can also remove an item by clicking on the "Remove" button next to the chosen product.

12.5. When you are ready, proceed to "Checkout" and follow instructions. Please ensure that you provide information as requested.

12.6. Once you have confirmed your order, we will issue you with a Magee 1866 Order reference number, which will appear in your order confirmation email. Please ensure that you save this number for reference.

12.7. Once you have made your choice and your order has been placed, you will be required to enter your payment details. When you have completed this process, please click on the "Make Payment" button.

12.8. Your order will be acknowledged by an Order Confirmation message which allows you to make a final review of your order, including your payment reference giving details as registered by our system. This message is NOT an acceptance of your order.

12.9. Magee 1866 will also send you an Order Confirmation email containing information as set out above and a second email informing you when your order is dispatched.

12.10. We reserve the right not to accept your order. Such non-acceptance may result, for example, from the fact that a product ordered is out of stock or that we are unable to obtain authorisation for your payment.

12.11. Furthermore, we retain the express right not to process a transaction at any time at our sole discretion. In this event, we will not be liable to you or any third party by reason of our withdrawing any merchandise from Magee 1866’s Online Shop, whether or not such products have been sold.

13. PAYMENT SAFETY AND SECURITY

We accept major payment cards, namely American Express, MasterCard and Visa . Payment will be debited and cleared from your account upon receipt of your order by Magee Clothing Limited. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to Magee Clothing Limited, we will not be able to process your order and a message will appear informing you that the transaction cannot be processed.

14. Magee Clothing Limited together with its partners, takes all reasonable care to make its Online Shop as secure as they can. All payment card transactions on this site are processed using a secure online payment gateway provided by our partner Skrill/Moneybookers, that encrypts your card details in a secure host environment. We do not hold your payment card details on the Magee server.

15. Although we will employ all reasonable care to ensure that details of your order and payment are held secure, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Magee 1866 Online Shop.

16. RETURNS AND EXCHANGE POLICY

We are happy to accept items returned to us within 28-days of purchase. We will refund your credit or debit card once the items are received and processed.

Items returned to us after the 28-day grace period will not be eligible for an exchange/credit. Any returns received outside this time frame may be considered at the discretion of Magee 1866, and may only be refunded as a credit against a future purchase.

Please understand that items must be returned to us in the same condition as they were shipped. They must be in an unused and perfectly saleable condition.

Magee 1866 reserves the right to refuse a return if it’s determined that an item has been worn and then returned for any reason other than being 'faulty'.

Payment for returns is the Customer's responsibility.

Please note that there are no returns on altered garments.

17. INTERNATIONAL SHIPPING

PLEASE NOTE: Certain countries may charge additional customs fees. Magee Clothing Limited B2B cannot reimburse you for any additional fees incurred.
